Draft: this document is pending review by an Indian lawyer and may change before final publication. It is presented in plain language for clarity.
1. Who we are
Awaaz (“Platform”) is operated by [Entity/Proprietor Name], [City], India (“we”). By using the Platform you agree to these Terms, the Privacy Policy, the Refund Policy, and the Community Guidelines.
2. What the Platform is — and is not
The Platform is a civic-technology service for hosting user campaigns, discussion, and volunteer coordination. We are not a charity or fundraising intermediary; we do not collect or transfer money to protesters or any third party. Campaigns are user speech, not our endorsement. We are not affiliated with any political party, protest organisation, or government body.
3. Eligibility
You must be at least 18 to create an account and make payments. Users below 18 may browse public pages; any account-holding by minors requires verifiable guardian consent as per applicable law.
4. Accounts
Keep your credentials secure; you are responsible for activity on your account; one account per person; no impersonation.
5. Memberships & payments
Membership is a one-time payment of ₹51 (price may change with notice for new members) granting ongoing member access; it does not auto-renew and we never auto-debit. Payments are accepted only through the official channel described in the Payment & UPI Policy (currently UPI handle thevoice@ptyes, revealed only on this website after the membership form). Boosts are paid promotional placements and are labelled as such. “Support Us” contributions are voluntary payments to the Platform for its operations. All prices include applicable taxes. Refunds per the Refund Policy. Payments made to any other handle, account, or person are not payments to us and we bear no liability for them.
6. User content & conduct
You own your content and grant us a licence to host and display it. You must not post content that: incites violence or property damage; constitutes hate speech; doxxes anyone; makes factual allegations about identifiable persons without credible cited sources; impersonates; infringes IP; violates any law or court order. Demands and opinions must be phrased as such. We may moderate, restrict, or remove content and accounts to enforce these Terms.
7. Campaigns & external links
Fundraiser links point to third-party platforms we do not operate or verify; use at your own judgment. We may reject or remove campaigns at our discretion, including via our pre-approval process.
8. Volunteers
Volunteer participation is additionally governed by the Volunteer Terms: volunteers are independent participants, not employees or agents; they handle goods only and never collect cash on the Platform’s behalf; they must log every intake and dispatch honestly (two-person confirmation for large dispatches); obey law and lawful police directions with personal safety first; make no public statements on the Platform’s behalf. Complimentary membership lasts while volunteer status is active; either side may end the arrangement anytime.
9. Assemblies & law
The Platform supports lawful, peaceful civic expression only. You are solely responsible for complying with laws, permits, and lawful directions of authorities at any physical gathering. We do not organise protests.
10. Disclaimers
The Platform, including help-zone and help-request features, is provided “as is” and “as available”; we do not guarantee availability, accuracy of user-posted information, or response to any help request. The Platform is not an emergency service — for emergencies call 112/108. Campaigns are expressions of opinion and demand; we make no promise that any campaign, vote count, or petition will produce any governmental, institutional, or other outcome, and no payment to the Platform buys influence over any campaign, vote, ranking, or outcome (paid boosts affect visibility only and are always labelled).
11. Limitation of liability
To the maximum extent permitted by law, our aggregate liability is limited to the amounts you paid us in the preceding 3 months.
12. Indemnity
You will indemnify us against claims arising from your content or your breach of these Terms.
13. Suspension & termination
We may suspend or terminate accounts for breach; you may delete your account anytime.
14. Grievance Officer (IT Rules, 2021)
[Name], support.janhisab@gmail.com, [address]. Complaints are acknowledged within 24 hours and resolved within 15 days.
15. Governing law & disputes
These Terms are governed by the laws of India; courts at [City] have exclusive jurisdiction.
16. Force majeure
We are not liable for delay or failure caused by events beyond our reasonable control, including internet or infrastructure outages, government or court orders, network shutdowns, strikes, or natural events.
17. Severability & entire agreement
If any clause of these Terms is held invalid or unenforceable, the remaining clauses continue in full force. These Terms, together with the Privacy Policy, Refund Policy, Payment & UPI Policy, and Community Guidelines, are the entire agreement between you and us regarding the Platform.
18. Changes
We may update these Terms; material changes will be notified in-app and apply prospectively from their effective date.
